En noviembre del año 2000, un grupo de paramilitares atacó el corregimiento de Nueva Venecia, una población aislada de la Ciénaga Grande de Santa Marta. Este documento argumenta que, a pesar de los múltiples instrumentos legales relativos a los derechos de las víctimas y a la justicia transicional, el Estado colombiano no ha conseguido reparar y dignificar a la población objeto de análisis. This article analyzes the evolution of state capacity in Peru during the recent commodity boom. Peru’s economic growth happened in a context in which inclusive democratic institutions were at play for the longest period ever registered in the country and at a time when political elites decided to invest considerable resources in developing state capacity. This case illustrates how boom-led economic growth can lead to the institutional strengthening of a weak state. However, state capacity continues to be low in Peru. (...) The causal mechanism that yields such continuity differs from those entertained in classic path-dependent explanations of state capacity in Latin America. The article identifies a novel mechanism that helped reproduce the Peruvian path intertemporally. This relational mechanism suggests that state capacity remains low because of the relatively enhanced capacities of state challengers to locally fend off and contest an otherwise much stronger state apparatus. The article argues, on that basis, the need to employ a relational analysis that gauges net state strength with respect to the power acquired by relevant non-state actors who might challenge state authority across different local arenas. Classic conceptualizations of state capacity are indeed relational, but conventional applications are predominantly unilateral and, thus, misleading. Unilateral notions of state capacity are those that focus on either state efforts and investments to assert state capacity or, alternatively, on the presence of challenges that curtail the levels of actually observed state capacity. In the present article we propose to approach and think about the event, the difference and the abyss. This is extremely important because it allows us to think about the individuation of the new. For this, we expose the positions of Heidegger and Deleuze. In the conclusions, we try to make dialogues both philosophies so that they are pushing each other trying to avoid justifying one position over the other.

Trata-se de uma análise das afinidades da filosofia de Schopenhauer (1788-1860) no pensamento de Emil Cioran (1911-1995). Autor influente na Romênia desde o século XIX, Schopenhauer é considerado uma das principais referências de Cioran. As fichas de leituras, cartas, expressões e os temas abordados por Cioran constituem uma gama de argumentos para aproximação do filósofo romeno ao filósofo do pessimismo.

El presente artículo examina la semántica de la anagnórisis en la diégesis de Tucídides y los poetas trágicos. Vinculando el corpus narrativo de la tragedia griega y de la stásis en la democracia de la Grecia Clásica, el texto formula dos ejercicios: Primero, mediante el examen de algunas especies lexicales que constituyen el campo semántico de la tragedia (hamartía, amatía y katastrophé), se establece el nexo entre «lance patético» y anagnórisis que acontecen al héroe trágico y al ciudadano ateniense narrado (...) por Tucídides. Segundo, mediante la indagación de los lexemas enunciados en la anagnórisis del héroe trágico y del ciudadano ateniense, con la noción de «sintagma trágico» el artículo imbrica el campo semántico de la diégesis trágica e historiográfica para postular la conjunción de una lengua trágico-política en común. In this paper, we propose to investigate one common adult representation of childhood that will serve both to reflect on and to problematize current and varied representations. As such, our object of study will always be a representation and not a substantialist definition. We propose to analyze the adult concept “child” from a critical perspective by reviewing it through a historical lens—that is, as it is expressed in the political and educational world of 19th century Chile, which, in turn, we (...) can glimpse in the historical writings of Domingo Faustino Sarmiento. To carry out this journey, we propose three guiding thematic axes: 1) how all school apparatuses embody, configure and assume a certain identifiable representation of “child’ and childhood; 2) an analysis of the characteristics and objectives of the 19th century Chilean school apparatus, particularly in its function as a government device, or dispositif; 3) just how that dispositif becomes visible to inquiry in the historical record, particularly in what it can reveal to us about the image or images of childhood held by adults. To be understood by adults as a boy or a girl in Chile during that period is communicated in the historical record through a myriad of diverse sources, each requiring consideration in its context. Magazines, syllabaries, school textbooks and children's stories configure different perspectives on and attitudes toward childhood, which in turn are associated with the social origin of these documents and the purposes they embody. The images, ideas and signs of interaction that appear in these school documents act cumulatively to reveal a cultural image of “child” and aid us in understanding the political and socio-cultural significance attributed to that period in the human life-cycle. And while we cannot claim to have identified how all adults of 19th century Chile understood and represented childhood, such documents do offer insights into the beliefs and assumptions of the political and ruling classes. Assim, aborda-se o que Popper considera como riscos da tolerância ilimitada e possibilidade de superação do conflito através da racionalidade no âmbito da linguagem, confrontando-se com a perspectiva e classificação adotada por Rainer Forst do conceito de tolerância e seus respectivos limites, bem como (...) sua adequação jurídica quanto ao tratamento dado ao “discurso de ódio” como definido e explorado por Jeremy Waldron. The issue of what constitutes a valid logical inference is a difficult question. At a minimum, we believe a permissible step in a proof must provide the reader with rational grounds to believe that the new step is a logically necessary consequence of previous assertions. However, this begs the question of what constitutes these rational grounds. Formalist accounts typically describe valid rules of inferences as those that can be found by applying one of the explicit rules of inference in the (...) formal system in which the proof is couched. However, philosophers of mathematics find such a description unhelpful because many inferences in the proofs that mathematicians actually produce cannot be expressed in a formal language, at least not without seriously distorting the semantic content of the inference (e.g., Larvor, 2012). In this chapter, we investigate mathematicians’ perceptions of a particular kind of inference in a particular setting. Specifically, we shed light on what types of graphical inferences mathematicians find permissible in a real analysis proof. Following Larvor (in press), we examine mathematicians’ reactions to metrical graphical inferences (i.e., inferences whose validity depends on the accuracy of the graph that was drawn and whose validity can be changed by minor deformations) and nonmetrical graphical inferences (i.e., inferences whose validity does not depend on a the accuracy of the graph and whose validity is not vulnerable to local deformations). The goal of this chapter is threefold. First, we demonstrate that most mathematicians reject metrical graphical inferences as impermissible in a real analysis proof. Second, we show that many mathematicians regard nonmetrical graphical inferences as permissible in a real analysis proofs. Third, we illustrate how mathematicians collectively disagree on the permissibility of nonmetrical inferences. (shrink)

Este trabajo tiene como objetivo argumentar a favor de la tolerancia de ciertas "inmoralidades inofensivas o sin víctimas". Tomando como punto de partida el liberalismo perfeccionista de Joseph Raz, así como la crítica que de él hace Robert P. George, se plantean argumentos a favor de tolerar ciertos males en aras de evitar que se instrumentalice a las personas. Como conclusión se afirma que, aunque equivocadamente, es posible elegir realizar acciones consentidas que atenten contra el principio del daño. This paper (...) argues for tolerance of some "harmless or victimless immoralities". To this end —and taking into account both Joseph Raz's perfectionist liberalism, and the critique of the latter by Robert P. George— arguments are set forth for tolerance of some evils aimed at avoiding using people as a means. El presente artículo tiene por objetivo analizar la lectura y los usos que realiza Álvaro García Linera de la sociología de Pierre Bourdieu. El marco teórico para realizar dicho estudio lo constituye la categoría gramsciana de traducción, referida al ejercicio de trazar equivalencias entre diferentes lenguajes científicos, filosóficos, políticos e históricos. La hipótesis que se sostiene es que García Linera traduce los principales conceptos de la sociología de Bourdieu a partir de un doble movimiento. Primero, a través de su puesta (...) en diálogo y fusión con la teoría crítica de Marx y la tradición del marxismo crítico. Segundo, a través del uso de dichos conceptos —una vez pasados por el tamiz del marxismo— para analizar las estructuras simbólicas de la clase obrera boliviana y la etnicidad como principio de distinción y de exclusión política del campesinado-indígena. The present article aims to analyze the reading and uses that Álvaro García Linera makes of Pierre Bourdieu's sociology. The theoretical framework of this study is the Gramscian category of translation, which refers to the exercise of drawing equivalences between different scientific, philosophical, political, and historical languages. The hypothesis that is maintained is that García Linera translates the main concepts of sociology of Bourdieu from a double movement. First, through its dialogue and fusion of these concepts with the theory of Marx and the tradition of critical Marxism. Second, using these concepts —once they have been screened by Marxism— to analyze the symbolic structures of the Bolivian working class and ethnicity as a principle of distinction and political exclusion of the indigenous peasantry. ResumenEl siguiente trabajo propone problematizar los supuestos construccionistas que subyacen a la teorización e investigación sociológica de los problemas públicos. Para ello, revisamos los componentes onto-epistémicos del construccionismo y su relación con los principales autores en este campo de investigación con el objetivo de tensionarlos a partir de las propuestas pragmatistas en el mismo ámbito. Nuestra propuesta es que la investigación en los problemas públicos se fortalece al cruzar ambas aproximaciones. Para demostrar el punto, nuestro argumento se plantea de la (...) siguiente manera. Luego de la introducción en la que fijamos el problema, presentamos los fundamentos construccionistas a partir del trabajo de Gusfield y sus derivados. Posteriormente, formulamos las propuestas pragmatistas francesas, siguiendo a Cefaï. A continuación, cerramos con una discusión en torno a la relación con los alcances empíricos, analíticos y políticos en el estudio de los problemas públicos.Palabras clave: construccionismo; pragmatismo; problemas sociales; públicos; reclamos públicos. El trabajo propone discutir el concepto de sociedad civil, para replantearlo desde una posición que privilegia el momento normativo de construcción teórica, desde una función epistemológica más que teórica, en sus articulaciones con la ciudadanía activa y con estrategias de gobernanza local que privilegian la pertenencia de la ciudadanía a una comunidad política determinada. En el marco de la globalización hoy los procesos de desarrollo local requieren complejizar las relaciones de actores que participan de estos procesos, más allá de la (...) relación Estado-Mercado. Para ello trabajamos un concepto normativo de sociedad civil y sus relaciones con la ciudadanía activa, que luego problematizamos con la inclusión de estrategias de participación ciudadana en la preocupación por la gobernanza local. Finalizamos con algunas notas sobre el rol de la investigación participativa en la relación anteriormente propuesta, todo enmarcado en un horizonte donde es posible otra democracia. (shrink)

A partir de la divergencia de M. Foucault con Th. Hobbes con respecto a la guerra como principio y fundamento del poder, se muestra la importancia de esa diferencia conceptual para los análisis políticos contemporáneos. Foucault sostiene que, en las sociedades modernas de Occidente, la comunidad política, y más precisamente la política misma, ha sido el terreno de la guerra librada por otros medios. Por extensión, esta tesis significa invertir el principio de von Clausewitz; a saber, que la guerra es (...) la continuación de la política por otros medios. On the basis of the difference between M. Foucault and Th. Hobbes regarding war as a principle and foundation of power, the article shows the importance of this conceptual difference for contemporary political analyses. Foucault argues that in modern Western societies, the political community and, more specifically, politics itself, has been the space of a war waged by other means. By extension, this thesis entails the inversion of von Clausewitz's principle, namely, that war is the continuation of politics by other means. A partir da divergência de M. Foucault com Th. Hobbes sobre a guerra como princípio e fundamento do poder, mostra-se a importância dessa diferença conceitual para as análises políticas contemporâneas. The Covid-19 pandemic disrupted in-person dispute resolution proceedings, leading to the rapid adoption of digital technologies for remote hearings in international arbitration. The use of these technologies has opened up new possibilities for enhancing procedures, improving efficiency, and streamlining processes. However, it also raises concerns about transparency and authenticity in virtual hearings. This paper explores the impact of digital technologies on the semiotics of law and legal communication in international arbitration, considering the intersections between new technologies and persuasion. Based on (...) practices like the use of e-evidence, debates surrounding remote hearings, and the formulation of standards for stakeholders’ behavior, the study takes a practice-based approach, exploring cognitive processes, such as memory and attention, and their influence on the behavior of counsel, arbitrators, and witnesses in remote hearings. It highlights the key issues, findings, challenges, and future research opportunities arising from the introduction of digital technologies in this field, including considerations on how stakeholders of a virtual hearings are affected by the unique features of the digital environment. Among the graphic peculiarities that the manuscript T 235 presents, the famous Alcoran in letter of the Christians kept in the Library of Castilla-La Mancha, it is noticeable the use of the abbreviation al̶h. to translate the term Allāh. Examined the different techniques used to that end in other manuscripts in Latin characters coming from the different Hispanic Islamic communities between the 16th and 17th centuries, ranging from non-translation to the equivalent coined and through the loan with different transcripts, we (...) propose an interpretation of the aforementioned abbreviation in terms of intersemiotic translation, i.e. as a reduction to a simple visual form that aims to keep in the Spanish version the fiction of retaining the term Allāh in its original form in Arabic spelling by means of Latin characters. La confrontación de Heidegger con el humanismo es bien conocida: es la forma de toda metafísica entendida desde la subjetividad. La tesis que se defiende en el ensayo es que hay otra forma de entender su relación con el humanismo desde un punto de vista espacial. Se establece una relación entre la concepción del espacio cotidiano y de lo «a la mano» en Ser y Tiempo, y la noción de colección en los primeros humanistas. De este modo se muestra que (...) el humanismo temprano no es un antecesor del subjetivismo cartesiano, y que, tal como lo proponen Gadamer o Grassi, representa una corriente que bebe de fuentes diferentes a la dominante en el pensamiento occidental. Predatory journals and conferences are an emerging problem in scientific literature as they have financial motives, without guaranteeing scientific quality and exposure. The main objective of the ASGLOS project is to investigate the predatory e‐email characteristics, management, and possible consequences and to analyse the extent of the current problem at each academic level. To collect the personal experiences of physicians’ mailboxes on predatory publishing, a Google Form® survey was designed and disseminated from September 2021 to April 2022. A total of (...) 978 responses were analysed from 58 countries around the world. A total of 64.8% of participants indicated the need for 3 or fewer emails to acquire a criticality view in distinguishing a real invitation from a spam, while 11.5% still have doubt regardless of how many emails they get. The AGLOS Study clearly highlights the problem of academic e‐mail spam by predatory journals and conferences. Our findings signify the importance of providing academic career‐oriented advice and organising training sessions to increase awareness of predatory publishing for those conducting scientific research. We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

El presente artículo es producto de una investigación multidisciplinaria e interinstitucional, fruto de la alianza entre la Universidad de San Buenaventura Medellín y el Centro de Familia VID-Obra de la Congregación Mariana de Medellín. Surge de una inquietud respecto a la manera en que se aborda la realidad institucional de las madres cabeza de familia, tanto en el ámbito político como empresarial. Para estudiar esta realidad, se partió de un modelo de investigación cualitativo, en donde se hizo una aproximación a (...) la población a partir de un cuestionario que permitiera identificar los roles y percepciones frente al ejercicio de la maternidad y la jefatura femenina, específicamente, cuando se trata de madres trabajadoras. Los resultados arrojados por la investigación permiten obtener una mirada psicosocial de la forma en que se ejerce el rol de madre y de figura de articulación familiar. (shrink)

Cancer is a singular cellular state, the emergence of which destabilises the homeostasis reached through the evolution to multicellularity. We present the idea that the onset of the cellular disobedience to the metazoan functional and structural architecture, known as the cancer phenotype, is triggered by changes in the cell's external environment that occur with ageing: what ensues is a breach of the social contract of multicellular life characteristic of metazoans. By integrating old ideas with new evidence, we propose that with (...) ageing the environmental information that maintains a multicellular organisation is eroded, rewiring internal processes of the cell, and resulting in an internal shift towards an ancestral condition resulting in the pseudo‐multicellular cancer phenotype. Once that phenotype emerges, a new local social contract is built, different from the homeostatic one, leading to tumour formation and the foundation of a novel local ecosystem. (shrink)

En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Por esta razón, el trabajo de Raz todavía puede ser considerado un buen punto de partida para analizar las relaciones entre normas, razonamiento práctico y lagunas jurídicas. Sin embargo, también mostramos que para admitir proposiciones que no son verdaderas ni falsas, las tesis de Raz deben ser reformuladas. De otra manera, la tesis de que no existen lagunas cuando el derecho guarda silencio no sería compatible con el rechazo de la bivalencia. /// In his paper "Legal Reasons, Sources and Gaps", Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principie of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show--with the aid of a sophisticated analytical tool, i.e., von Wright's truth-logic--that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth-values. For this reason, Raz's paper can still be regarded as a good starting-point for analyzing the relationships between norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

Una forma clásica de explicar el significado de una oración es establecer sus condiciones deverdad. Sin embargo, dado que sólo las oraciones declarativas encajan con este tipo de análisis, las oraciones (e.g. imperativas) que carecen de valor de verdad quedan fuera de este análisis. Con el objeto de evitar esta dificultad, algunas veces se ha sugerido que el cumplimiento de un imperativo les el valor semántico de I, y que este valor depende del concepto de verdad. En este artículo, explicamos (...) esta sugerencia mediante un lenguaje artificial: el lenguaje LN. Nuestra propuesta consiste en suministrar una reconstrucción del concepto de eficacia a partir de la relación de cumplimiento, analógamente a la reconstrucción del concepto de verdad a partir de la relación de satisfacción. Nuestras conclusiones principales son las siguientes: 1) el significado de una oración imperativa es establecido por sus condiciones de eficacia y 2) esta teoría del significado de los imperativos suministra una base semántica, adeucada para la lógica deóntica.A classical way of explaining the meaning of certain sentences is to establish their truth-conditions. However, since only declarative sentences fit this kind of analysis, sentences (e.g. imperatives) which lack truth-value remain outside the theory of meaning. In order to avoid this difficulty, it is sometimes suggested both that compliance with an imperative I is the semantic value of I, and that this value is dependent on the concept of truth. In this article, we explain this suggestion with the help of a constructed language: the artificial language NL. Our proposal Is to provide a reconstruction of the concept of effectiveness from the relation of compliance, on the analogy of the reconstruction of the concept of truth from the relation of satisfaction. Our main conclusions are: 1) the meaning of a imperative sentence would be established by its effectiveness-conditions and 2) this theory of meaning of imperatives would provide a semantic basis, suitable to the deontic logic. O presente artigo busca compreender o conceito de corpo em Henry David Thoreau. Para isso, o texto se divide em três momentos: o primeiro, que tem por objetivo expor como se entende, inicialmente, o corpo como um dualismo preso entre as experiências do civilizatório e o selvagem; o segundo, que parte de uma compreensão desde a experiência dos rios para expor uma corporalidade líquida como ponto conhecimento e de relação com o mundo; e, finalmente, o terceiro expõe a filosofia thoreauviana (...) do caminho como uma maneira de compreender o corpo desde o terreno e, por sua vez, como devir. Tudo isso a partir de uma interpretação filosófica que permite compreender a corporalidade em Thoreau como uma possibilidade experiencial capaz de produzir pensamento a partir de uma mística com a natureza; ou seja, no autor há uma filosofia que compreende o estar-no-mundo como uma experiência intimamente ligada com a natureza. In his influential paper Legal Reasons, Sources and Gaps' reprinted in The Authority of Law (Oxford: Oxford University Press, 1979), Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the (...) claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principle of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show ‐ with the aid of a sophisticated analytical tool, i.e. von Wright's Truth Logic ‐ that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth‐values. For this reason, Raz's paper can still be regarded as a good starting‐point for analyzing the relationships among norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

En el presente artículo tratamos algunos de los desafíos que un constitucionalismo global tiene actualmente respecto a la consecución de una justicia cosmopolita: pluralismo jurídico más allá del monismo jurídico y cultural del Estado moderno, sociodiversidad e interculturalidad, y sostenibilidad socioecológica de los modos de vida legitimados jurídicamente. Para ello consideraremos cómo entiende la tradición escolástico-católica de la Modernidad temprana las exigencias de lo común que atraviesan todo fenómeno jurídico en la vida colectiva y entre los pueblos, atendiendo específicamente a (...) algunas contribuciones clave de Francisco Suárez. De otra parte, como contrapunto del humanismo escolástico católico trataremos la visión de la Modernidad liberal, la cual plantea un modelo racional unívoco y ahistórico de configuración tanto de las exigencias de justicia entre los pueblos, como del modo de propiedad, el cual se identifica con una única forma de propiedad individual desvinculada de las exigencias del bien común. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la (...) versión fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

El objetivo de este artículo será el de proponer un análisis de las obras de danza contemporánea argentina Recorte de Jorge Cárdenas Cayendo (2017) creada por la Compañía Terceto bajo la dirección de Juan Pablo Gómez e Instrumento para estrellar (2018) de la coreógrafa Diana Szeinblum, en diálogo con conceptos de teoría política y teoría de la danza. Las obras citadas retoman imágenes y secuencias de movimiento de la movilización de diciembre de 2001 y de otros levantamientos populares (...) de Latinoamérica, para proponer diferentes modos de teorización coreográfica del acontecimiento político. Si como afirma Rancière, la subjetivación política supone una instancia previa de desidentificación, la tesis que propone este texto es que esa instancia se corresponde con la intervención de un cuerpo en movimiento. El estallido social puede ser entendido, de ese modo, como una experiencia coreográfica colectiva de desidentificación capaz de habilitar la emergencia histórica de un nuevo sujeto político. Does self-control require willpower? The question cuts to the heart of a debate about whether self-control is identical with some psychological process internal to the agents or not. Noticeably absent from these debates is systematic evidence about the folk-psychological category of self-control. Here, we present the results of two behavioral studies (N = 296) that indicate the structure of everyday use of the concept. In Study 1, participants rated the degree to which different strategies to respond to motivational conflict exemplify (...) self-control. Participants distinguished between intra-psychic and externally-scaffolded strategies and judged that the former exemplified self-control more than the latter. In Study 2, participants provided various solutions to manage motivational conflict and rated their proposals on effectiveness. Participants produced substantially more intra-psychic strategies, rated them as more effective, and advised them at a higher rate than externally-scaffolded strategies. Taken together, these results suggest that while people recognize a plurality of strategies as genuine instances of self-control, purely internal exercises of self-control are considered more prototypical than their externally-scaffolded counterparts. This implies a hierarchical structure for the folk psychological category of self-control. The concept encompasses a variety of regulatory strategies and organizes these strategies along a hierarchical continuum, with purely intra-psychic strategies at the center and scaffolded strategies in the periphery. From our everyday commuting to the gold medalist’s world-class performance, skillful actions are characterized by fine-grained, online agentive control. What is the proper explanation of such control? There are two traditional candidates: intellectualism explains skillful agentive control by reference to the agent’s propositional mental states; anti-intellectualism holds that propositional mental states or reflective processes are unnecessary since skillful action is fully accounted for by automatic coping processes. I examine the evidence for three psychological phenomena recently held to support anti-intellectualism and (...) argue that it supports neither traditional candidate, but an intermediate attention-control account, according to which the top-down, intention-directed control of attention is a necessary component of skillful action. Only this account recognizes both the role of automatic control in skilled action and the need for higher-order cognition to thread automatic processes together into a unified, skillful performance. This applies to bodily skillful action in general, from the world-class performance of experts to mundane, habitual action. The attention-control account stresses that, for intentions to play their role as top-down modulators of attention, agents must sustain the intention’s activation; hence, the need for reflecting throughout performance. Researchers often claim that self-control is a skill. It is also often stated that self-control exertions are intentional actions. However, no account has yet been proposed of the skillful agency that makes self-control exertion possible, so our understanding of self-control remains incomplete. Here I propose the skill model of self-control, which accounts for skillful agency by tackling the guidance problem: how can agents transform their abstract and coarse-grained intentions into the highly context-sensitive, fine-grained control processes required to select, revise and (...) correct strategies during self-control exertion? The skill model borrows conceptual tools from ‘hierarchical models’ recently developed in the context of motor skills, and asserts that self-control crucially involves the ability to manage the implementation and monitoring of regulatory strategies as the self-control exercise unfolds. Skilled agents are able do this by means of flexible practical reasoning: a fast, context-sensitive type of deliberation that incorporates non-propositional representations into the formation and revision of the mixed-format intentions that structure self-control exertion. The literatures on implementation intentions and motivation framing offer corroborating evidence for the theory. As a surprising result, the skill of self-control that allows agents to overcome the contrary motivations they experience is self-effacing: instead of continuously honing this skill, expert agents replace it with a different one, which minimizes or prevents contrary motivations from arising in the first place. Thus, the more expert you are at self-control, the less likely you are to use it. (shrink)

Effort and the feeling of effort play important roles in many theoretical discussions, from perception to self-control and free will, from the nature of ownership to the nature of desert and achievement. A crucial, overlooked distinction within the philosophical and scientific literatures is the distinction between theories that seek to explain effort and theories that seek to explain the feeling of effort. Lacking a clear distinction between these two phenomena makes the literature hard to navigate. To advance in the unification (...) and development of this area, this article provides an overview of the main theories of the nature of effort and the nature of the feeling of effort, and then discusses how efforts and their feelings are related. Two key takeaways emerge. First, there is widespread agreement that efforts are goal-directed actions. Second, one of the main philosophical issues to be decided is whether feelings of effort should be defined by reference to efforts (effort-first approach), or whether efforts are defined by reference to the feeling of effort (feeling-first approach). This paper proposes a conceptual model that fosters interdisciplinary thinking and critical thinking by connecting the three main philosophical traditions that impact modern thinking – British empiricism, Continental Europe subjective idealism, and realism – with their epistemological foundations and in combination with modern social disciplines: ethics, social responsibility, and political economy. Through a statistical analysis this paper shows which of the three epistemologies produces better social outcomes.

Self-control, the capacity to resist temptations and pursue longer-term goals over immediate gratifications, is crucial in determining the overall shape of our lives, and thereby in our ability to shape our identities. As it turns out, this capacity is intimately linked with our ability to control the direction of our attention. This raises the worry that perhaps social media are making us more easily distracted people, and therefore less able to exercise self-control. Is this so? And is it necessarily a (...) bad thing? This paper analyzes the nature of attention, its vices and virtues, and what currently available evidence has to say about the effects of social media on attention and self-control. The pattern that seems to be emerging is that, although there is an association between higher use of social media and lower attentional control, we do not yet know whether it is social media use that makes people more distracted, or whether those who use social media the most do so because they are more easily distracted. Either way, the rise of the ‘Web 2.0’ does raise questions about whether the virtues of attention will change in the future, and whether this will bring with it a transformation in the way we shape our selves. Concerns about threats to human autonomy feature prominently in the field of AI ethics. One aspect of this concern relates to the use of AI systems for problematically manipulative influence. In response to this, the European Union’s draft AI Act (AIA) includes a prohibition on AI systems deploying subliminal techniques that alter people’s behavior in ways that are reasonably likely to cause harm (Article 5(1)(a)). Critics have argued that the term ‘subliminal techniques’ is too narrow to capture the target cases (...) of AI-based manipulation. We propose a definition of ‘subliminal techniques’ that (a) is grounded on a plausible interpretation of the legal text; (b) addresses all or most of the underlying ethical concerns motivating the prohibition; (c) is defensible from a scientific and philosophical perspective; and (d) does not over-reach in ways that impose excessive administrative and regulatory burdens. The definition is meant to provide guidance for design teams seeking to pursue responsible and ethically aligned AI innovation. (shrink)
